Equality in Action:
Equal Rights Amendment

Did you know that gender discrimination is not prohibited by the Constitution of the United States?

The Esler Family Foundation (EFF) believes our nation is long overdue for the Equal Rights Amendment (ERA) to become the 28th Amendment to the Constitution.

  • The Amendment states: Equality of rights under the law shall not be denied or abridged by the United States or by any state on account of sex.

  • The Constitution does not prohibit discrimination on the basis of sex. Gender discrimination currently receives “intermediate scrutiny” in the courts, whereas other forms of discrimination receive “strict scrutiny.” As a result, victims of gender discrimination cases only have a 47% chance of winning their case. These cases include employment situations like hiring, firing and pay gaps, sexual harassment and assaults, maternity leave, self-defense incarceration, uninvestigated rapes, and much more.

To put this statistic in perspective, discrimination cases for race, religion, or country of origin have a 73% likelihood of winning.

  • The three most significant impacts of the ERA will be: 1) Closing the gender equality gap in the Constitution; 2) Providing a framework for the Supreme Court to interpret "gender equality of rights under law"; 3) Anchoring gender equality laws in the Constitution to prevent rollback of hard-won legislation.
